Terms and Conditions – Homeday

Welcome to Homeday (under Aroma Real Estate), a platform providing on-demand home services. By using our website, app, or services, you agree to comply with the following Terms and Conditions. If you do not agree with these terms, please refrain from using our services.

1. Introduction

These Terms and Conditions govern your use of Homeday’s services, applications, and websites (collectively, the “Services”). By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms, including any updates made to them.

2. User Eligibility

You must be at least 18 years old to use the Homeday platform. By using the platform, you represent and warrant that you are eligible to enter into a binding contract.

If you are using the Services on behalf of a business or organization, you confirm that you have the authority to bind that business or organization to these Terms.

3. Services Provided

Homeday offers a platform for users to book services from independent third-party service providers, such as maids, healthcare professionals, electricians, and more. The availability of services may vary depending on your location.
    •    For Customers: You can browse available service categories, view service providers, book appointments, and make payments via our platform.
    •    For Service Providers: You can sign up, create a profile, manage bookings, and receive payments for the services provided.

Note: Homeday acts as an intermediary between customers and service providers but does not directly employ the service providers.

4. Account Registration and Security

To use certain features of our Services, you may need to create an account. When registering, you agree to:
    •    Provide accurate and complete information
    •    Keep your account information up to date
    •    Maintain the confidentiality of your account credentials and be responsible for any activity under your account

Homeday is not responsible for any unauthorized access to your account. If you believe your account has been compromised, immediately contact us at: support@homedayservice.com.

5. Booking Services

By booking a service through Homeday, you:
    •    Acknowledge that Homeday does not guarantee the quality, availability, or timeliness of services provided by third-party service providers.
    •    Agree to pay the specified service fees, which may vary depending on the service category, location, and other factors.
    •    Authorize Homeday to collect payment for the services booked via the platform.

6. Payments and Fees

All payments for services booked through the platform will be processed securely through third-party payment gateways (e.g., Razorpay). Homeday does not store any of your financial data.

Service fees, cancellation fees, and other charges will be clearly communicated to you at the time of booking. Any changes to service fees will be updated in real-time on the platform.

7. Cancellation and Refunds

You can cancel a booking through your Homeday account. Cancellations made within the specified cancellation window may be eligible for a refund. Refunds are subject to Homeday’s policies, which are provided at the time of cancellation.
    •    If a service provider cancels the service, Homeday will try to reschedule or offer a full refund.
    •    Refund requests must be made within 7 days of the booking date.

8. User Responsibilities

As a user of the Homeday platform, you agree to:
    •    Provide accurate information when registering or booking services
    •    Comply with all applicable local laws, including tax obligations
    •    Not use the platform for any unlawful purpose or in a manner that may harm or disrupt our services or the services of others
    •    Not engage in any activity that could damage, disable, or impair the functionality of Homeday’s services

9. Service Providers’ Responsibilities

Service providers using the Homeday platform agree to:
    •    Provide accurate service details and pricing information
    •    Ensure timely and professional conduct when providing services
    •    Comply with all applicable local laws and regulations related to their services
    •    Maintain a valid profile, including providing identity verification when requested

Homeday reserves the right to remove any service provider who violates these terms or fails to meet our standards of service.

10. Limitation of Liability

To the fullest extent permitted by law:
    •    Homeday is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.
    •    Homeday does not guarantee the quality, reliability, or safety of services provided by third-party service providers.
    •    Homeday is not responsible for any loss or damage caused by any errors or omissions in the services offered.

11. Termination of Services

Homeday reserves the right to terminate or suspend your access to the platform if you violate these Terms and Conditions or engage in activities that may harm the platform or other users.

Upon termination, your right to use the Services will cease immediately, and you must stop using our platform.

12. Privacy Policy

By using Homeday’s platform, you agree to our Privacy Policy, which outlines how we collect, store, and use your personal information. Please refer to the Privacy Policy for more details.

13. Indemnification

You agree to indemnify, defend, and hold harmless Homeday, its affiliates, directors, employees, and agents from any claims, losses, or damages, including legal fees, arising from your use of the Services, violation of these Terms, or violation of any applicable laws.

14. Dispute Resolution

Any disputes arising under or in connection with these Terms will be resolved through arbitration, and the location for arbitration will be Delhi, India. You agree to submit to the jurisdiction of the courts in Delhi for any legal action related to these Terms.

15. Modifications to Terms

Homeday reserves the right to modify, update, or change these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the website or app. We recommend reviewing these Terms periodically to stay updated.

16. Governing Law

These Terms and Conditions are governed by the laws of India, without regard to its conflict of laws principles.

17. Loyalty Points

Homeday offers a Loyalty Points Program to reward users for booking services through the platform. By participating in the Loyalty Points Program, you agree to the following terms:

Earning Points:
Loyalty points are earned automatically upon successful completion of eligible service bookings made through the Homeday platform. The number of points earned may vary based on service category, booking amount, and promotional offers.

Using Points:
Accumulated loyalty points can be redeemed for discounts on future service bookings. Redemption rates and eligible services for point usage will be specified on the platform and may be updated periodically.

Validity:
Loyalty points are valid for a fixed period from the date of issuance (e.g., 12 months), after which they may expire if not used.

Non-Transferable:
Points are non-transferable, non-exchangeable for cash, and can only be used by the account holder who earned them.

Fraud and Abuse:
Homeday reserves the right to cancel, modify, or revoke loyalty points in the case of suspected fraud, misuse, or violation of the Terms and Conditions.

Program Changes:
Homeday may update or discontinue the Loyalty Points Program at any time without prior notice. Any changes will be reflected in the Terms and on the platform.
